Folgender Fall:

AN schickt per Anwalt ein Schreiben um Besserung des Zeugnisses an AG.

AG nimmt dazu Stellung und sagt Nein; dann klagen Sie doch...

AN klagt.

AN lädt als Zeugen 3/4 aller Kunden des AG ein.

AG bekommt dies mit, macht einen Deal mit dem AN und der AN bekommt ein Zeugniss mit Beurteilung "gut" da der Imageschaden und ggf. Finanzielleschaden eines Prozesses mit Vorladung der Kundschaft zu groß wäre.
